Gifts to physicians: OK if directed towards better care of pts (eg, textbooks, modest meals)
COI / Conflict of interest: any financial relationship <12 mo (salary, royalty, intellectual property, consulting fee, honoraria, stocks (excluding diversified mutual funds), gifts) When presenting, need to limit talk to research data and results. If involved with organization of CME, need to disclose and exclude self from discussion of potential COI.
Anti-kickback law: cannot accept bribe for using company product (OK employee compensation, investments in small joint health care ventures)
Stark law: prohibits referrals to company that MD/immediate family has financial relationship with. Whistle blower gets 15-30% of settlement.
EMTALA: limits inter-institutional transfer of pts. Hospitals must accept referred pt if it has capacity and capability
Reportable diseases: AIDs (HIV varies state to state), ACTIVE TB
Malpractice: most grow from initial outpatient setting (elective, young, spine pts)
